Khaled secured a finding of no fact proven against out client, C, a nurse who was accused of sexual assault against a vulnerable patient.
C was alleged to have carried out an opportunistic assault by penetration in 2021, while the patient as experiencing a seizure. Despite a police investigation concluding that there was insufficient evidence to bring a prosecution against C, the NMC determined in February 2023 that he had a case to answer.
In a substantive NMC hearing spanning 13 months, the panel heard evidence from the patient herself, a colleague of C and a neurological expert, with over 400 pages of evidence for the panel to consider.
Over the course of three sittings of the hearing, as well as two preliminary hearings, Khaled made extensive submissions on the numerous legal issues that arose, in order to safeguard C’s right to a fair hearing at each and every turn. At the conclusion of the evidence in February 2026, Khaled made further detailed submissions to the panel on all of the evidence it had heard and read, highlighting the inconsistencies and fundamental flaws in the NMC’s case, which led the panel to conclude that none of the charges against C could be found proven, bringing the case to an end.
