Rebecca and Khaled represented our client, O, an occupational therapist, over the course of a 13-day hearing. O was accused of making inaccurate mileage claims, dishonesty and incomplete record keeping. The case involved detailed analysis of hundreds of mileage claims and patient records, raising significant arguments as to whether O had been dishonest at all.
Khaled dealt with preliminary matters in the initial stages, including an application to adjourn, with Rebecca going on to deal with the examination of witnesses. Following extensive submissions by Rebecca, the panel found that although some inaccuracies were proven, dishonesty was not.
The hearing having gone part heard, it resumed and, on hearing Rebecca’s further submissions on misconduct and impairment, the panel concluded that the facts found proven were not capable of amounting to serious professional misconduct, and that they reflected not any material financial gain but O’s attempts to go “above and beyond” in caring for his patients. The case concluded at that point, with no adverse findings in relation to O’s professional practice, not even requiring consideration of whether he was currently impaired.
